Changing syndic

Four steps, and no reason to give

A syndic is appointed for a fixed term: simply not renewing the mandate ends it. Owners need give neither grounds nor justification.

Ask for our proposal

Send us the latest meeting minutes and the current budget. We prepare a costed proposal, free and without obligation.

Add it to the agenda

The council, or any single owner, writes by recorded delivery to add our candidacy. Do this one to three months ahead, and always before the meeting notices go out.

The vote

We attend to present our proposal and answer questions. The meeting votes under the Article 25 majority — a majority of all owners.

The handover

Within one month the outgoing syndic hands over the cash position, then the archives. We handle the chasing and keep you posted.

Changing syndic, fees, common parts, voting from abroad: the questions British owners ask us most.

Do you deal with owners in English ?

Yes. We correspond with overseas owners in English and explain the technical points of French copropriété law in plain terms. Do note that official documents — meeting notices, minutes, the syndic contract and the accounts — are issued in French, as the law requires. We are happy to talk any of them through with you.

What exactly is a syndic ?

A syndic de copropriété is the professional appointed to run a block of flats in France. The nearest UK equivalent is a managing agent, with two important differences: there is no freeholder — the owners themselves appoint and dismiss the syndic by vote — and the mandate is for a fixed term, typically one year, renewed each year at the general meeting.

How do I change syndic ?

You need no reason and no justification. The council of owners, or any single owner, writes to the sitting syndic by recorded delivery asking for the candidate syndic to be added to the agenda of the next general meeting. This must be done before the meeting notices go out — allow one to three months. The meeting then votes under the Article 25 majority.

I live in the UK and cannot attend the meeting. What can I do ?

Three options. Give a proxy (pouvoir) to another owner or a third party; vote by post on the standard form, now fully recognised in law; or attend by video link where the building has voted to allow it. Many of the owners we act for live in Britain and vote by post as a matter of routine.

What are your fees ?

A clear annual fixed fee, set according to the number of lots and the building's equipment — lift, communal heating, caretaker. We do not use those sprawling contracts whose clauses for so-called special services end up doubling the headline figure. Our proposal spells out exactly what is included. See our fees page.

What is the difference between common and private parts ?

Common parts belong to all the owners: structure, roof, façades, entrance hall, stairwell, lift, communal pipework, grounds. Their upkeep is funded by service charges and decided at the meeting. Private parts are your own lot: finishes, non-loadbearing partitions, internal fittings. Some elements are for your exclusive use yet remain common — a balcony slab, for instance. Which areas do you cover ?

Saint-Omer, Boulogne-sur-Mer, Calais, Dunkirk, Hazebrouck, Le Touquet, Lille and Béthune, together with surrounding communes in the Pas-de-Calais and Nord. Simply tell us where the building is when you get in touch.

Are the building's funds protected ?

Yes. Each building holds its own separate bank account, as the ALUR Act requires; funds never pass through a pooled account. We also carry a financial guarantee of €907,000 with CEGC and professional indemnity insurance with MMA. This bonding requirement is a feature of the French regulated profession and has no direct UK equivalent.
